Coal is our heritage, our connection to family and it can never be replaced. Mining coal is not just a job, it is a way of life; coal is the lifeblood of West Virginia’s legacy. Congressman Evan Jenkins has given up on coal, BUT I HAVE NOT. I am THE SAVE COAL CANDIDATE. Legislation to end the Federal Governments War on Coal through the Clean Power Plan proposed by the Executive Branch on August 3, 2015, to re-establish State energy authority and return to the lawful 1990 version of the Clean Air Act. This bill will remonstrate the Clean Power Plan which unjustly empowers the Environmental Protection Agency;
The regulations enforced by the EPA are:
an unconstitutional expansion of the Clean Air Act
an unconstitutional lawmaking which undermines congressional authority under Article 1 Section 1 violating the rule of law
violating the general welfare of the people of West Virginia, their families and in other coal producing states
endangering the well-being of thousands possibly even millions of American citizens
irresponsibly violating the Tenth Amendment right of the States to manage their own energy portfolio by unlawfully allowing the EPA to manage energy production
an over-reach by the EPA without considering the costs or economic damages
Places an unnecessary financial hardship on our senior citizens and the lower and middle class Americas with increased utility costs
a threat to the National Security by jeopardizing the energy grid through excessive restrictions and limiting resource options
a threat to the National Security by jeopardizing the supply of high quality coal required in the production of military grade steel needed in the defense of our nation
unconstitutionally forcing States to submit to federal energy policy
doing irreparable damage to the welfare of the people that the Constitution requires the Federal Government to protect
doing irreparable damage to West Virginia and other States sovereignty
placing a devastating economic burden on West Virginia and other coal producing or dependent States while allowing foreign coal to continue to be imported
overstepping the EPA’s authority as environmental regulator by circumventing Congressional authority by becoming a centralized energy planning authority to select winners and losers without regard to the damage inflicted
unprecedented power grab that threatens the well-being of over half the states in the United States union
directly costing thousands of jobs in West Virginia and tens of thousands of livelihoods, families and their welfare
forcing energy generation facilities to incur expensive renovations increasing energy costs
costing over 140,000 jobs in the coal industry nationwide along with a vast number of indirectly related employment opportunities
a human rights issue affecting real people detrimentally in violation of the stated purpose of the role of the Federal Government
violating the Preamble of the U.S. Constitution to secure the blessings of Liberty
rejecting the supreme authority of God as the provider of our natural resources
ignoring a reliable, abundant domestic form of energy that is inexpensive and readily available
providing other nations with an economic advantage over the United States
This bill will re-establish Congressional oversight and State Sovereignty by terminating the unlawful Clean Power Plan and returning to the 1990 version of the Clean Air Act. The Clean Power Plan is a tyrannical violation of the constitutional authority given to the Executive Branch of the People’s Government. This bill will restore congressional authority over the Environmental Protection Agency and limit the funding to enacted legislation.
The Clean Power Plan ignores recent research by MIT researchers who have found a way to “make electricity from coal twice as environmentally friendly.” (http://www.sciencedirect.com/science/article/pii/S0378775316301574). This new technology will make coal cleaner than before making it an attractive energy resource for the present and the future.
The Clean Power Plan overlooks the role of government to defend the people instead of destroying their way of life. There is a whole cultural attachment to coal mining that goes beyond jobs, it is a way of life a family legacy that should not be devastated and erased from our society.
The Clean Power Plan ignores the property right violations of natural gas. In order, to build pipelines, eminent domain is being used unlawfully to confiscate personal property violating people’s rights solely for private corporate gain. The general welfare is not a corporate balance sheet or a CEO’s bottom line. The Clean Power Plan by the Federal Government is not only devastating the State of West Virginia it is creating massive hardships on American Citizens in many states in the union. Currently half the States have filed legal action due to the burden this unlawful plan will have on any state where the people depend on coal or low cost energy resources.
Coal mining is not just a job it is a way of life. It is the lifeblood of West Virginia’s legacy. I will fight to restore my state’s honorable heritage. This War on Coal is devastating to every coal mining family in America and must be stopped.
